The third commercial release for Ours also saw the first commercial recordings with guitarists Static and Locke, a duo that the band auditioned to fill the shoes of guitarist Dave Milone after he left the band to pursue a solo project in 2002. Mercy… is also the first Ours record to showcase the producing talents of Rick Rubin, who took over the project when Dreamworks' music division was inherited by Geffen Records.

Mercy features songs about love and loss, including one that Ours' songwriter Jimmy Gnecco explains is about the birth of his son (Worst Things Beautiful), and one about the late Jeff Buckley, whom Gnecco considered a personal friend (Saint). Shortly after the release of the previous album, Precious, Gnecco's girlfriend commited suicide, an event that weighed heavily on Gnecco's conscience. The last track on Mercy…, Get Up, features Gnecco's daughter providing vocals, and contains lyrics of redemption and an end to guilt.

Ours relied on grassroots promotion, rather than label support for Mercy…, utilizing street teams for hype, and even producing their own extended video for the songs Live Again and God Only Wants You.
